Welcome to MakeClipAI ("MakeClipAI", "we", "us", or "our"). These Terms of Service ("Terms") govern your access to and use of the MakeClipAI website, applications, video generation tools, account features, billing features, public showcase, and related services (collectively, the "Service").
By accessing or using the Service, creating an account, purchasing credits or a subscription, or submitting prompts or media for generation, you agree to be bound by these Terms. If you do not agree, you must not use the Service.
These Terms should be read together with our Privacy Policy, Refund Policy, Acceptable Use Policy, Cookie Policy, and DMCA Policy.
You must be legally able to enter into a binding agreement to use the Service. If you use the Service on behalf of a company, organization, or other entity, you represent that you have authority to bind that entity to these Terms.
When you create an account, you must provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You must notify us promptly if you believe your account has been compromised.
We may refuse registration, suspend accounts, or terminate accounts where we believe there has been abuse, fraud, policy violations, security risk, or unlawful activity.
MakeClipAI provides AI-powered video generation and related creative tools. Depending on the available features, users may submit text prompts, images, videos, configuration parameters, or other inputs to generate or edit video content.
Generation results may vary based on your prompt, selected model, input quality, queue status, provider availability, safety filters, and technical limitations. We do not guarantee that any generated output will match your expectations, be error-free, be unique, or be suitable for any particular purpose.
We may modify, suspend, discontinue, limit, or update any part of the Service at any time, including models, pricing, credit costs, features, usage limits, and availability.
MakeClipAI may route generation requests to third-party AI model providers, infrastructure providers, payment providers, authentication providers, storage providers, analytics providers, and other vendors. These providers may include, without limitation, fal.ai, kie.ai, Creem.io, and other service providers used to operate the Service.
We do not control third-party model behavior, output quality, moderation decisions, uptime, or infrastructure availability. Your use of the Service may also be subject to applicable third-party provider terms and policies.
MakeClipAI is an independent product and is not affiliated with, endorsed by, or sponsored by any AI model provider unless expressly stated otherwise.
You retain any rights you have in prompts, uploaded assets, media, metadata, and other materials you submit to the Service ("Inputs"). Subject to applicable law and third-party rights, you may use generated content produced through the Service ("Outputs") for personal or commercial purposes, unless your plan, applicable law, model provider terms, or these Terms state otherwise.
You grant MakeClipAI a worldwide, non-exclusive, royalty-free license to host, store, process, transmit, reproduce, display, moderate, analyze, and otherwise use Inputs and Outputs as reasonably necessary to provide, maintain, secure, improve, and enforce the Service. This includes processing your content through third-party providers for generation, safety review, abuse prevention, debugging, and support.
You are solely responsible for your Inputs, Outputs, and how you use or distribute them. You represent and warrant that you have all necessary rights, permissions, consents, and lawful basis to submit your Inputs and use the Outputs, including rights relating to copyrighted materials, trademarks, names, images, voices, likenesses, personal data, and privacy or publicity rights.
Due to the nature of AI systems, Outputs may be similar or identical to content generated for other users. We do not guarantee exclusivity, originality, copyrightability, or legal clearance of any Output.
You must comply with our Acceptable Use Policy. You agree not to use the Service to create, upload, request, publish, distribute, or facilitate content or activity that:
We may review, block, remove, disable, or restrict content and accounts if we believe they violate these Terms, our policies, third-party provider policies, or applicable law.
If you submit content to public showcase, gallery, sharing, or community features, you authorize us to display, distribute, promote, moderate, remove, and otherwise use that content in connection with the Service.
Public showcase submissions may be subject to review before publication. We may approve, reject, remove, edit metadata, restrict visibility, or disable access to public content at our discretion, including for legal, safety, quality, abuse, or policy reasons.
Do not publish content that you do not have the right to share publicly.
MakeClipAI operates on a credit-based system. Credits may be included in subscriptions, granted as promotions, or purchased separately. Credits are consumed based on the selected model, generation type, duration, resolution, quality settings, and other parameters shown in the Service.
Credit costs may change over time. We may impose usage limits, rate limits, queue limits, abuse-prevention limits, or model-specific limits.
If a generation fails because of a system error or provider failure, credits may be automatically refunded according to our system rules. Credits may not be refunded where a generation completes but the result is unsatisfactory, where your prompt or input violates policy, where a provider safety system blocks the request, or where failure is caused by user error, unless otherwise required by law or stated in our Refund Policy.
Subscription credits may expire according to the applicable plan terms, typically at the end of the billing period. One-time credit packages expire according to the terms displayed at purchase, if any. Promotional or free credits may expire, be limited, or be revoked at our discretion.
Paid services may be offered as recurring subscriptions, one-time credit purchases, or other paid plans. Prices, credit amounts, included features, and billing intervals are shown at checkout or in the pricing page.
Subscriptions renew automatically at the end of each billing period unless canceled before renewal. You authorize our payment processor and Merchant of Record, currently Creem.io, to charge applicable fees, taxes, and renewal amounts using your selected payment method.
You may cancel your subscription through your account settings, customer portal, or other cancellation method we provide. Cancellation stops future renewals but does not automatically refund the current billing period. Your paid access generally continues until the end of the current billing period, unless otherwise stated.
All purchases are subject to our Refund Policy. Except where required by law or expressly stated by us, payments are non-refundable, and we do not provide partial refunds for unused subscription time, unused credits, or dissatisfaction with generated outputs.
Prices may exclude taxes, duties, currency conversion fees, bank fees, or payment processor charges unless stated otherwise. You are responsible for any taxes or charges applicable to your purchase.
Payment processing is handled by third-party providers. We do not store full payment card details. Payment failures, chargebacks, fraud alerts, or disputed payments may result in suspension or termination of paid features or your account.
The Service, including software, interfaces, designs, logos, trademarks, documentation, website content, workflows, databases, and other materials, is owned by MakeClipAI or its licensors and is protected by intellectual property and other laws.
Except for the limited right to use the Service under these Terms, we do not grant you any ownership or license to our intellectual property. You may not copy, modify, distribute, sell, lease, reverse engineer, or create derivative works from the Service except as allowed by law or with our written permission.
If you believe content on the Service infringes your copyright, please follow our DMCA Policy. We may remove or disable access to allegedly infringing content, notify users, process counter-notices, and terminate repeat infringers when appropriate.
Our collection and use of personal data is described in our Privacy Policy. By using the Service, you acknowledge that your Inputs, Outputs, account data, device data, usage data, and payment-related data may be processed as described in the Privacy Policy.
Do not submit sensitive personal data or third-party personal data unless you have a lawful basis and all required permissions.
The Service is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted access, error-free operation, data retention, specific generation times, queue priority, model availability, or compatibility with your systems.
Some features may be experimental, beta, preview, or subject to change. Beta features may be unstable, inaccurate, limited, or discontinued without notice.
We may suspend, restrict, or terminate your account or access to the Service at any time if we believe you violated these Terms, created legal or security risk, abused the Service, engaged in fraud or chargebacks, or used the Service in a way that may harm us, other users, third parties, or the public.
You may stop using the Service at any time. Termination does not relieve you of payment obligations incurred before termination. Certain provisions of these Terms will survive termination, including provisions relating to intellectual property, user responsibility, disclaimers, limitation of liability, indemnity, and dispute resolution.
To the maximum extent permitted by law, the Service and all Outputs are provided "as is" and "as available" without warranties of any kind, whether express, implied, statutory, or otherwise. We disclaim all warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, and reliability.
We do not warrant that Outputs are accurate, lawful, non-infringing, unique, commercially usable, or suitable for your intended use. You should independently review and verify Outputs before publishing, distributing, or relying on them.
To the maximum extent permitted by law, MakeClipAI and its owners, operators, affiliates, employees, contractors, suppliers, and providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, business interruption, reputational harm, or cost of substitute services.
To the maximum extent permitted by law, our total liability for any claim related to the Service or these Terms will not exceed the amount you paid to MakeClipAI for the Service during the three (3) months before the event giving rise to the claim, or USD $100, whichever is greater.
You agree to defend, indemnify, and hold harmless MakeClipAI and its owners, operators, affiliates, employees, contractors, suppliers, and providers from and against any claims, damages, liabilities, losses, costs, and expenses, including reasonable attorneys' fees, arising from or related to your use of the Service, your Inputs or Outputs, your violation of these Terms, your violation of law, or your infringement of any third-party rights.
We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date and may provide additional notice where appropriate. Your continued use of the Service after changes become effective means you accept the updated Terms.
If you do not agree to the updated Terms, you must stop using the Service and cancel any paid subscription before the next renewal.
